Craigweil House Conservation Area Article 4 Direction Consultation

Craigweil House Conservation Area was designated as a Conservation Area by Arun District Council on the 15th April 2009. The plan of the Conservation Area together with the Conservation Area Statement can be viewed by clicking on the following link Craigweil House Conservation Area

In order to help protect the special character and appearance of the Conservation Area, the Council is in the process of preparing two Article 4(1) Directions. These Directions remove certain permitted development rights as such development could be harmful to the character of an area. The Council propose adopting the following two Article 4 Directions:

1. to prevent the enclosure of the open verge areas abutting the roadways with Fencing or Walls

The verge areas are extremely important features of the area and make a considerable contribution to the visual character of the Conservation Area. The Article 4 Directions will apply to all residential curtilages within the Conservation Area. Verge areas are taken to be those areas between a defined front, side or rear boundary (e.g. fence, wall or other means of demarcation) and the hardened carriageway of a roadway.

2. to exercise the control over the provision of hard standings in front gardens and verge areas

The spacious, green and open character of the estate is an important characteristic and it is important that there should be controls over proposals for new hard surface areas to front gardens.

 

Public Consultation

The Council is publishing draft Article 4 Directions for a period of public consultation from the 10th June to the 30th June, 2010. The Council is required to publish a Public Notice announcing the consultation. A public notice of the consultation has been published in the local press and distributed to residents in the Craigweil House Conservation Area.

The Council are inviting comments in writing regarding the proposals and request that these are addressed to:

Copies of the Article 4 Directions and associated documents are available to view at the Arun Civic Centre at the above address, the Bognor Regis Town Hall, Clarence Road, Bognor Regis, West Sussex during normal office hours (Mondays to Thursdays between 0900 -1700 hrs and Fridays 0900-1645 hrs) and at Willowhale Library, Pryors Lane, Rose Green, Bognor Regis, PO21 4JF.

Following consideration of the comments received the Council will determine whether Article 4 Directions will be adopted in respect of the Craigweil House Conservation Area. It is anticipated that the Council will take a decision on the 13th October 2010. Residents of the Craigweil House Conservation Area will be informed in writing of the decision.

 

Designation of Craigweil House as a Conservation Area

Public consultation was undertaken (ending 12th December 2008) regarding the designation of Craigweil House as a Conservation Area under Section 69 of the Planning (Listed Buildings and Conservation Areas) Act 1990.

There were various supporting documents including a Proposed Conservation Area Statement, which describes the historic significance of the area and a description of the proposed conservation area; a Plan, which shows the suggested boundary of the area and the buildings which it is considered make a positive contribution to the character of the area; a general paper entitled Conservation Areas, which includes a summary of the effect of designation; and a letter concerning the proposal from English Heritage dated 20th June 2008.

Arising from consultation with the public and local organisations a good response was received with over 130 questionnaires and letters being submitted.

All comments received were summarised in a report which was considered by the Council's Cabinet on the 23rd February 2009. It was recommended that designation should take place but arising from the comments received amendments be made to the Conservation Area Statement and Plan. The recommendations of Cabinet were ratified by Full Council at its meeting on 15th April 2009 and the Craigweil House area was designated as a Conservation area. A report concerning the use of Article 4 Directions was considered by the Council's Cabinet at its meeting on 20th April 2009 and it has been agreed that Article 4 Directions restricting the enclosure of verge areas and the formation of hard standings in front gardens will be issued by Arun District Council and property owners will be advised accordingly in due course.

Article 4 Directions are used to remove certain Permitted Development Rights (rights to develop without securing planning permission from the Local Planning Authority).
