Late Night Refreshment

How does the Act define the 'provision of late night refreshment'?
 
The Act attempts to regulate those premises where people may gather between 11:00pm and 5:00am giving rise to the possibility of disorder and disturbance. Premises licences will therefore be required by any premises that sells hot food or hot drink between 11:00pm and 5:00am.  The Act does not try to regulate premises that sell immediately consumable food such as bread or milk.
 
Late Night Refreshment is defined as Hot Food and Hot Drinks (above room temprature) supplied between the Hours of 23:00 and 05:00.  Hotels have a an exemption under Schedule 2 of the Licensing Act 2003.
