Planning application validation requirements 2022
This list applies to applications for planning permission for works to flats, new dwellings, commercial developments, changes of use, outline applications, reserved matters and applications to vary or remove a condition.
If you are making a joint planning and listed building application you will need to complete an application for planning permission and listed building consent for alterations, extension or demolition of a listed building and also refer to the listed building validation requirements. If you are making a joint planning and advertisement consent application, you will need to complete an application for planning permission and consent to display advertisement(s) form and also refer to the advertisement consent validation requirements.
This list contains the minimum requirements for a planning application to be accepted as valid, but we may need to request further information during the life of the application to enable it to be decided.
Please do not make the application until you have finalised all the details of your project and obtained all the information needed. If necessary, you should consider discussing the work with your own planning consultant before making your application. If an invalid application is submitted, all the missing information must be provided within two weeks of request, unless otherwise agreed in writing. Where all the validation information is not provided, the application will be returned and refunded, with a fee of £40.00 per application being retained cover the cost of administering the return. Generally, once validated your application will be decided based on the information you have submitted and it is unlikely that we will accept any changes unless the application is following our pre application advice and the amendments are minor. If changes are made it is likely that the application will have to be re-advertised and reconsulted on and this will delay the decision.
Sometimes where there is not sufficient information submitted with the application, planning conditions are placed on the approval requiring that further information is submitted and approved before you can proceed. If this is the case, you will need to submit a follow up application which will incur a further fee and this could cause delays in you starting work on your project. Applicants may find it useful to be aware of the standard pre-commencement conditions that may be imposed so that they can consider submitting this information up front to avoid delays with commencing on site. https://www.arun.gov.uk/planning-pre-commencement-conditions. It would be particularly useful for applicants to be aware of the amount of monitoring information that needs to be provided in relation to drainage conditions so that data can start to be collected as soon as possible.
We can only accept electronic plans in pdf format and the plans must be scanned to actual document size (not to fit) so that they can be accurately scaled. If printed plans are provided, please make sure that they are printed out to actual size not ‘fit to page’ so they can be measured. It would be helpful if you ensure that all the electronic plans are submitted as individual pdf’s and not combined into one document as we will only have to separate them out to upload them against the application on the website. Please ensure none of the supporting documents you provide contain signatures, phone numbers or email addresses as these will need to be redacted. If a document has to be redacted by us, it will not be possible to view it in colour on the website. If providing photographs, please make sure they do not include people who can be identified, children or car number plates. If they do, please make sure they are redacted before submitting them to us.

2. Ownership certificates and agricultural land declaration
Types of application that require this information

What information is required?
An ownership certificate A, B, C or D on the application form must be completed stating the ownership of the property. Where the site includes an agricultural holding, all agricultural tenants must be notified prior to the submission of the application and their details must be included on the relevant certificate.
It should be noted that in the event of any part of a new development including guttering, foundations or opening windows overhanging or crossing onto a neighbouring boundary, ownership certificate A should not be completed. Notice should be served on the owner and an alternative certificate completed.
For this purpose, an ‘owner’ is anyone with a freehold interest, or leasehold interest the unexpired term of which is not less than 7 years.
Notice(s)
A notice to owners of the application site must be completed and served in accordance with Article 13 of the DMPO. There are three versions of this notice, a householder article13 notice, a minor commercial article 13 notice and a planning article 13 notice.

3. Design and access statement (DAS).
Types of application that require this information
A design and access statement is required for an application for planning permission for (a)major development; (b)where any part of a proposed development is in a designated area1 and consisting of i) one or more dwelling houses 2; or ii) a building/s where the floor space created by the development is 100 square metres or more.
1 Designated area’ is a Conservation Area or a World Heritage Site.
2Dwelling house does not include a building containing one or more flats, or a flat contained within such a building.
This does not apply to applications for planning permission
- to develop land without compliance with conditions previously attached, made pursuant to section 73 of the Town & Country Planning Act 1990(a);
- to replace an extant planning permission in order to extend the time limit for implementation; for approval of reserved matters following outline approval;
- for engineering or mining operations;
- for a material change in use of the land or buildings;
- for waste development.

4. Fire statement

5. Environmental statement

An environmental statement is needed for certain types of development. Information can be found in the Town and Country Planning (Environmental Impact Assessment) Regulations 2017.

This is a specialised area of planning and you may need to seek your own professional advice.
You can seek a formal opinion (a screening opinion) as to whether an environmental statement is needed before you submit your planning application. If a statement is needed, you can make an application for a scoping opinion which gives details of what the statement should contain.

6. Outline applications
Types of application that require this information
Outline planning applications.

What information is required?
Applications for outline planning permission generally do not need to give details of any proposed reserved matters. However, where an outline application is being made with access as a reserved matter the outline permission shall state the area or areas where the access points to the proposed development will be situated.
If a local authority receives an application for outline planning permission but decides that the application should not be considered separately from all or any of the reserved matters, it must notify the applicant within 1 month of receipt of the application that further details must be submitted. This situation should not be confused with applications where inadequate information is submitted.
7. Fee

What information is required?
The fee for planning submissions is variable dependent on planning type.
Concessions may be available for development entirely connected with proposals for disabled access to public buildings or for development needed solely for a disabled person. You are advised to check with the Technical Support Unit if you believe your application may benefit from an exemption.
All information relating to an invalid application must be provided within two weeks of request, unless otherwise agreed in writing. Where all the validation information is not provided, the application will be returned and refunded, with a fee of £40.00 per application being retained by Arun District Council to cover the cost of administering the return.

8. Location plan
Types of application that require this information

What information is required?
An up to date plan accurately reflecting the site at a scale of 1:1250 or 1:2500.
The application site must be edged clearly in red and must include all land necessary to carry out the proposed development including the land required to access the site from a public highway, visibility splays, landscaping and car parking. The plan must include at least one named road and a north point. In rural locations it may not be possible to include a named road, in which case please ring the Technical Support Unit to discuss an alternative option.
Where a visibility splay is required, West Sussex County Council have advised that a splay is formed for a 30mph speed limit road by measuring from a point 2.4m back from the kerb edge in the centre of the proposed access. A line should then be drawn from either side of this point for 43m in each direction to the nearside edge of the carriage way. The splays must intersect land only within the control of the applicant, or within the publicly maintained highway. The distance will increase with the speed limit of the road. If the road has a 40mph speed limit then the distance should be 120m either side. 9. Other plans, drawings and information necessary to describe the development.

What information is required?
The Town and Country Planning (Development Management Procedure) (England) Order 2015 states that an application needs to be accompanied by any other plans, drawings and information necessary to describe the development which is the subject of the application. It does not specify beyond this but custom and practice has established that these are the block plan, floor plans, elevations, sections and roof plans as specified in the local validation requirements below.

The national validation requirements state that an application needs to be accompanied with any other plans, drawings and information necessary to describe the application.

Custom and practice has established that these are:
Block plan. An up to date plan accurately reflecting the site at 1:500 or 1:200 scale clearly indicating the proposed development in relation to the site boundaries and other existing buildings on the site, site access details, distances of the development from the boundary and a north point.
Elevations. Existing and proposed elevations at a scale of 1:50 or 1:100. Where the application is for a change of use and there is no external change, it is possible to submit one plan clearly labelled existing and proposed.
Floor plans. Existing and proposed floor plans at a scale of 1:50 or 1:100. Where the application is for a change of use and there is no change to the floor plan it is possible to submit one set of plans clearly labelled existing and proposed.
Site layout plans. For all applications where there is a change of site levels up or down within the site of more than 150mm. These should indicate existing and proposed levels across the site and the levels on adjoining sites so that the impact of the development on the site and adjoining sites is clear. Where it is not possible to provide site levels on adjoining sites another repeatable measure can be agreed with the Council’s engineers.
Topographical Survey. On major applications for 10 or more dwellings or commercial sites of more than 1 hectare, where the land level changes up or down by more than 150 mm, a grid of levels with points not less than 20m apart need to be provided for pre and post construction levels.
Sections. Existing and proposed sections and finished floor and site levels in metres to 2 decimal points across the site and on adjoining sites at a scale of 1:50 or 1:100. The plan should show a cross section through the proposed building. Where there is a change in ground levels or the proposal is on a sloping site drawings should show both existing and finished floor and site levels and a datum point and also show the proposals in relation to adjoining buildings.
Roof plans. Roof plans are required when there is a change to an existing roof and on all new buildings.
Street scenes. Street scene drawings or photomontages are required when a proposal is set between existing development and is visible form the public realm. They should show how the proposal integrates with the adjacent buildings.
Parking plan. For applications of 5 or more dwellings, the conversion of a building to flats or commercial developments of 500sq m of commercial floor space a parking plan is required. The plan needs to be at a scale of 1:200 clearly showing the parking layouts that indicate the ability to access and egress from the site in forward the gear, turning areas consistent with the size and frequency of vehicles visiting a site, provisions to enable safe and convenient movement for pedestrians and facilities for cyclists, disabled users and where appropriate motor cyclists.

3. Affordable housing statement.
Types of application that require this information
Applications for 11 or more residential units will require a minimum 30% of the total number of units proposed on site to be provided as affordable housing.

What information is required?
Where affordable housing is being provided on site, a statement setting out the following is required:
- Number and mix of affordable units.
- Mix of tenure of affordable units.
- Plans showing location of units.
- Details of floor space provision for each unit type.
In circumstances where the provision is being made off site or by way of a commuted sum, robust evidence including, where appropriate a viability appraisal will need to be submitted. This will form part of the planning application and will be published in full on the website.
For schemes of 11 or more units a Planning Obligation (often referred to as s.106 agreements) will be required to secure the necessary provision whether this be on-site, or in exceptional circumstances off site or a commuted sum payment.

4. Pagham Harbour access management contribution legal agreement.

Applications with a net gain of 1 or more residential units. In accordance with Policy ENV DM2 The Arun Local Plan 2011-2031.
Please be advised that if the site requires other forms of contributions a bespoke agreement would need to be prepared to cover the additional contributions.

What information is required?
For all net gain of residential units applications within the Pagham Harbour buffer zones A & B, there is a requirement for a financial contribution to be made for Pagham Harbour access management.
A standard legal agreement template has been drawn up for applications where there is a net gain of less than 9 units and no other contribution is required. This needs to be completed and signed by all the land owners and anyone with an interest in the land such as the mortgage company. Please be aware that where there are several parties with an interest in the land, it can take some time to get the deed signed. This is requested as a validation requirement because the agreement must be completed, checked and if necessary corrected before the decision can be issued. By submitting it up front this will allow the application to be determined within the statutory time scales and avoid delays or possible refusal due to lack of a completed agreement.

5. Draft deed of variation
Types of application that require this information
Section 73 applications where the original planning permission which is being varied was subject to a Section 106 Agreement and that agreement does not contain a clause enabling it to be applied to subsequent applications.

What information is required?
To enable the speedy processing of the application to vary or remove a condition, a draft deed of variation needs to be submitted with the application. Applicants are advised to have instructed their legal team and need to be aware that a further legal fee will be required to cover the council’s costs in drawing up the deed.
6. Biodiversity survey and report to include a biodiversity net gain statement.
Types of application that require this information
A survey is needed for applications for 10 or more dwellings and any application which may directly or indirectly affect
- Sites of Special Scientific Interest (SSSIs);
- Ancient woodland;
- Local nature reserves;
Sites of nature conservation importance (SNCIs) / local wildlife sites (LWS);
- Nature improvement areas;
- Habitats of principle importance
- Biodiversity opportunity areas;
- Sites where protected species or species of principle importance have been recorded or are likely to be present;
- Also required for development including the modification, conversion, demolition or removal of buildings and structures (especially roof voids) where protected species or species of principle importance are likely to be present.

7. Flood risk assessment.

Applications less than 1 ha where there is a change of use in development type to a more vulnerable class (eg. from commercial to residential), where they could be affected by sources of flooding other than rivers and the sea (eg. surface water drains).

If the development is located within the Lidsey Foul Water Treatment Catchment Area, it will be necessary to confirm on the application form whether the proposal involves connection to the mains foul water drainage.
If the proposal is not connecting to the mains drainage, the application will be held as invalid unless it is accompanied by a full environmental assessment as agreed at Full Council on 11 January 2012.

10. Land contamination assessment (LCA)
Types of application that require this information
Major and minor applications for planning permission for operational development on sites where the previous land use is likely to have resulted in contamination including fuel filling stations, gas works, landfills and industrial sites etc.

A desk study report incorporating the findings of a site walkover by a suitably qualified practitioner that is sufficient to conclude whether contamination is likely to be present. If contamination is suspected, the report should incorporate a preliminary risk assessment in the form of a conceptual model of the pollutant linkages as well as proposed means by which any identified pollutant linkages can be broken.

- Assessment of heritage significance of the heritage asset or assets which may be affected by the proposed development, including their setting (Significance is defined as the value of a heritage asset to this and future generations because of its heritage interest. That interest may be archaeological, architectural, artistic or historic);
- Assessment of the likely impact of the proposed development on the heritage asset(s) and their setting; and
- A statement outlining a mitigation strategy to address any impacts of the proposed development on the significance of the heritage asset(s). This might include modification of methods, materials chosen or design and/or archaeological or architectural investigation and recording.
The statement should be proportionate in detail to the type of works being carried out. For example, a major scheme that affects several assets will require an extensive and professionally produced heritage statement. A small-scale scheme that has limited impacts will probably require a short statement.
As a minimum, applicants are expected to consult the West Sussex County Council Historic Environment Record (HER) for information on the history of the building, site or area as well as the National Heritage List for England produced by Historic England, relevant local plan policies and any available Conservation Area Character Appraisals.

Transport assessment (TA) and travel plan (TP). A TA should address the following issues; reducing the need to travel, especially by car – ensure, at the outset, that thought is given to reducing the need to travel; consider the types of uses (or mix of uses) and the scale of development in order to promote multipurpose or linked trips; promote accessibility by all modes of travel, in particular public transport, cycling and walking; assess the likely travel behaviour or travel pattern to and from the proposed site; and develop appropriate measures to influence travel behaviour; provide accurate quantitative and qualitative analyses of the predicted impacts of residual trips from the proposed development and ensure that suitable measures are proposed to manage these impacts; and ensure as much as possible that the proposed mitigation measures avoid unnecessary physical improvements to highways and promote innovative and sustainable transport solutions. However, where innovative and sustainable transport solutions do not fully mitigate the adverse impact of personal travel from a development, there may be a necessity to provide highway infrastructure improvements to deal with the residual development impacts.
