Notice of public path diversion order

Public path diversion order 2021

The Council made the above Order on the 5th October 2021. The effect of the Order will be to divert existing sections of Footpath No, 3038 on land at Ivy Lane Footbridge, Ivy Lane, Bognor Regis PO22 8AE, as follows:

  • The Footpath on the Footbridge which is shown by a bold black intermittent line; and
  • The Footpath on the Pavement which is shown by a short black dash line.

The new route of the footpath on the Footbridge having a minimum width of 2 metres throughout commences at Point C on the Order Map (Grid ref: E: 493855.795 N:100140.114). From Point C the new route of the footpath on the footbridge continues in a northward direction through Network Railway boundary for approximately 13 metres where it joins Point D (Grid ref: E:493865.311 N:100148.970) and then continues eastwards to Point E (Grid ref: E:493877.580 N:100135.787) for approximately 18 metres, and then in a southern direction to Point F (Grid ref: E: 493868.230 N: 100126.422) for approximately 13 metres as shown by a bold black intermittent line on the Order Map.

The new route of the footpath on the Pavement having a minimum width of 2 meters throughout commences at Point A on the Order Map (Grid ref: E:493868.124 N:100152.996). From Point A the new route of the footpath on the pavement continues in an easterly direction to Point B (Grid ref: E:493870.181 N:100150.307) for approximately 3 metres and then descends south to Point I (Grid ref: E: 493856.225 N: 100137.292) for approximately 19 metres. In addition, the new route of the footpath on the pavement runs from Point H (Grid ref: E: 493881.917 N:100131.230) in a westerly direction for approximately 8 metres to Point G (Grid ref: E: 493875.838 N: 100137.080) and descends south to Point J (Grid ref: E: 493868.230 N: 100127.384) for approximately 14 metres as shown by a short black dash line in the Order Map.

A copy of the Order and Order Map have been placed and may be seen free of charge on the website of Arun District Council at https://www.arun.gov.uk/wscc-rights-of-way-notices and Bognor Regis Town Council at https://www.bognorregis.gov.uk/Planning_25006.aspx. Copies of the Order may be purchased at the price of £5.00 from the Interim Legal Services Manager, Legal Services at Arun District Council.

Any representations about or objections to the Order may be sent in writing to the Group Head of Planning at Arun District Council, The Civic Centre, Maltravers Road, Littlehampton, BN17 5LF (quoting ref: BR/81/20/RAI) not later than 2 December 2021. Please state why you object.

If no representations or objections are duly made, or if any so made are withdrawn, Arun District Council may confirm the Order as an unopposed Order. If the Order is sent to the Secretary of State for the Environment for confirmation, any representations and objections which have not been withdrawn will be sent with the Order.

Diversion order 2021

 

This Order is made by Arun District Council under Section 257 Town and Country Planning Act 1990 because it is satisfied that it is necessary to divert the footpath to which this Order relates in order to enable development to be carried out in accordance with a planning permission granted under Part Ill Town and Country Planning Act 1990 namely prior approval under Part 18, Schedule 2 of the General Permitted Development Order 2015 for the replacement of the Ivy Lane pedestrian bridge over the railway (planning application ref: BR/81/20/RAI).

BY THIS ORDER

[1] The footpath marked by a continuous black line on the attached Order Map ("the Order Map") and described in Part I of the Schedule to this Order ("the Schedule") shall be diverted as provided below.

[2a] There shall be created to the reasonable satisfaction of Arun District Council and West Sussex County Council an alternative footpath on the footbridge for use as the said footpath as provided in Part 2(a) of the Schedule and shown by a bold black intermittent line on the Order Map.

[2b] There shall be created to the reasonable satisfaction of Arun District Council and West Sussex County Council an alternative footpath on the pavement for use as the said footpath as provided in Part 2(b) of the Schedule and shown by a short black dash line on the Order Map.

[3] The diversion shall take effect on the date on which the Arun District Council certifies that the terms of Articles 2a and 2b above have been complied with.

[4] The following works shall be carried out in relation to the footpath described in Part 2(a) of the Schedule, that is to say:

(a) The alternative footpath shall be of a width no less than 2 metres.

(b) The alternative footpath shall be free from all obstructions and must not include any

stiles, gates, posts or other structure.

(c) The construction of the alternative footpath shall be to a specification to be agreed

with the Director of Highways and Transport, West Sussex County Council.

(d) The new footpath will be waymarked by West Sussex County Council.

[5] The following works shall be carried out in relation to the footpath described in Part 2(b) of the Schedule, that is to say:

(a) The alternative footpath shall be of a width no less than 2 metres.

(b) The alternative footpath shall be free from all obstructions and must not include any

stiles, gates, posts or other structure.

(c) The construction of the alternative footpath shall be to a specification to be agreed

with the Director of Highways and Transport, West Sussex County Council.

(d) The new footpath will be waymarked by West Sussex County Council.

[6] Network Rail are hereby required to pay the cost of carrying out the above-mentioned works.

[7] Where immediately before the date on which the footpath is diverted there are apparatus under, in, on, over, along or across it belonging to statutory undertakers for the purpose of carrying on their undertaking, the undertakers shall continue to have the same rights in respect of the apparatus as they then had.

Part 1

Description of Site of Existing Path or Way which is to be Stopped Up

Part of public footpath No. 3038 commencing at Point R on the Order Map (Grid ref: E:493868.124 N: 100152.996) running in an easterly direction for approximately 4 metres to Point S (Grid ref: E: 493871. 729 N: 100149.658) dipping down for approximately 5 metres to Point T (Grid ref: E: 493868.356 N: 100146.485) in a southern direction before continuing in an easterly direction for 20 metres to Point U (Grid ref: E: 493881.917 N:100131.230) as shown by a continuous black line on the Order Map.

 

Part 2(a)

Description of Alternative Footpath as Diverted on the Footbridge

The new route of the footpath on the footbridge having a minimum width of 2 metres throughout commences at Point Con the Order Map (Grid ref: E: 493855.795 N:100140.114). From Point C the new route of the footpath on the footbridge continues in a northward direction through Network Railway boundary for approximately 13 metres where it joins Point D (Grid ref: E:493865.311 N:100148.970) and then continues eastwards to Point E (Grid ref: E:493877.580 N:100135.787) for approximately 18 metres, and then in a southern direction to Point F (Grid ref: E: 493868.230 N: 100126.422) for approximately 13 metres as shown by a bold black intermittent line on the Order Map. The gradient along the downward elevation and upward elevation of the Alternative Footpath as Diverted on the Footbridge has a minimum running slope of approximately 1 :20.

 

Part 2(b)

Description of Alternative Footpath as Diverted on the Pavement

The new route of the footpath on the pavement having a minimum width of 2 meters throughout commences at Point A on the Order Map (Grid ref: E:493868.124 N: 100152.996). From Point A the new route of the footpath on the pavement continues in an easterly direction to Point B (Grid ref: E:493870.181 N:100150.307) for approximately 3 metres and then descends south to Point I (Grid ref: E: 493856.225 N: 100137.292) for approximately 19 metres. In addition, the new route of the footpath on the pavement runs from Point H (Grid ref: E: 493881. 917 N:100131.230) in a westerly direction for approximately 8 metres to Point G (Grid ref: E: 493875.838 N: 100137.080) and descends south to Point J (Grid ref: E: 493868.230 N: 100127.384) for approximately 14 metres as shown by a short black dash line in the Order Map. The gradient along the downward elevation and upward elevation of the Alternative Footpath as Diverted on the Pavement has a minimum running slope of approximately 1 :20.
