Schedule of Saved Policies
IMPORTANT PUBLIC NOTICE SAVED DEVELOPMENT PLAN POLICIES
The Planning and Compulsory Purchase Act 2004, contained a provision for the saving of policies in adopted or approved local and structure plans for a period of three years from the commencement date of the Act, which was 28th September 2004. Policies in these plans expired on 27th September unless the Secretary of State agreed to their extension beyond that date.
The Development Plan for Arun comprised the Arun District Local Plan 2003; the West Sussex Structure Plan 2004; and the West Sussex Minerals Local Plan 2003.
The Secretary of State’s assessment of whether saved policies should be extended is based upon the criteria set out in Planning Policy Statement 12: Local Development Frameworks and the Department for Communities and Local Government protocol on saving policies.
The Secretary of State has granted consent for the Arun District Local Plan policies in the schedule below to be saved under the provisions of the Act. Those policies not listed have now expired. It is important to note that the Arun District Local Plan policies will be saved until such time as they are replaced by new policies in an adopted development plan document or are no longer compliant with national and regional planning policy.
You will need to contact West Sussex County Council to find out which West Sussex Structure Plan and West Sussex Minerals Local Plan policies have been saved under these provisions.
Following 27 September 2007, the ’saved’ policies should be read in context. Where policies were adopted some time ago, it is likely that material considerations, in particular the emergence of new national and regional policy and also new evidence, will be afforded considerable weight in decisions.
