Exempt Work

 

As you may  be aware, some building work does not require a formal application under the Building Regulations, so long as such works meet set criteria. For buildings such as conservatories, certain garages etc., please see Schedule 2 which supports Building Regulation 9. 

Whilst the work may not need Building Regulation approval for such works, planning permission may still be required. In such instances, please contact planning@arun.gov.uk for further details.

 

Conservatories

A conservatory will only be considered exempt under the Regulations if all of the following criteria are met:

  1. Must have a floor area of no more than 30m2 and be situated at ground level
  2. Glazing must satisfy the requirements of Approved Document N
  3. No structural alteration is required to form a new opening into the conservatory from the dwelling
  4. Existing separation is maintained where the opening is not to be enlarged
  5. Any new glazed door/window giving access to the conservatory is either installed by a FENSA registered installer, or an application is made for any replacement window/door
  6. Any electrical work is carried out by a Part P registered electrician
  7. Any heating has separate temperature controls and on/off controls
  8. The erection of the conservatory does not adversely affect any part of the existing building (including means of escape in case of fire)

If the conservatory is to be built over, or close to a public sewer, it will require the consent of Southern Water Services Ltd. It will generally not be possible to convert an exempt structure to a controlled structure at a later date (conversion to a habitable room). Planning permission may be required before constructing a conservatory.

 

Detached garages

A detached garage will not require a Building Regulations application of the following criteria are met:

  1. The floor area does not exceed 30m2
  2. No part of the garage is less than 1m from the boundary, or is constructed substantially of non-combustible material
  3. The erection of the garage does not adversely affect any part of the existing building

If the garage is to be built over, or close to a public sewer, it will require the consent of Southern Water Services Ltd. It will generally not be possible to convert an exempt structure to a controlled structure at a later date (conversion to a habitable room). Planning permission may be required before constructing a garage.
